The state cannot order schools to open in the state. That decision has to be made in the individual counties. The agreement reached in Sacramento is to provide an incentive for the school districts to open classrooms to students. The agreement sets aside $6.6 billion to provide incentive to help schools reopen by March 31. There are more details that will be revealed by the Governor. Basically, California counties are divided up into different coronavirus infection levels, with each tier having specific rules about how businesses and other public spaces can operate during the pandemic. To be eligible for the new money, districts in the most restrictive tier, known as the purple tier, must return to in-person instruction at least through the second grade. Districts in the next highest tier, the red tier, must return to in-person instruction for alkl elementary school grades, plus at least one grade in middle and high schools
