The hearing panel for the Imperial County Air Pollution Control District recently rendered  its decision on the Red Hill Bay notices of violation. The decision was made soon after the parties made their closing arguments. The Imperial Irrigation District is not happy with that decision. General Counsel for the District, Frank Oswalt, has said they basically rubber stamped the recommendations of the APCD staff. He said there was no discussion of the serious deficiencies perpetrated by the APCD in this case, which were repeatedly raised by IID's counsel during the course of the hearing. Tuesday the IID Board of Directors voted in closed session to file litigation against the County and the Air Pollution Control District.
