(Court rules in favor of Brawley)....The ruling was in a lawsuit filed in 2021.

At the time, Vertical Bridge wanted to construct a cell phone tower within Wiest Field Park. The City and Vertical entered into a option to lease agreement. Latter, the Brawley City Council denied  a Conditional Use Permit requested by Vertical Bridge. Vertical claimed Breach of Contract and filed a lawsuit against the city. Earlier this month the US District Court, Southern District of California ruled in favor of Brawley. The court ruled once the CUP was denied, the contract was terminated. The City has said they were pleased with this initial victory, but they are prepared for eventual appeals to the ruling.
