Some say the vote may have violated the Brown Act because the issue was not on the agenda, and it caught many by surprise. The Imperial Irrigation District contends the Board was discussing the IID Budget at the time, and they say the motion and subsequent vote was in context of the larger discussion. IID interim General Council Ross Simmons says he does not feel the action violated the Brown Act. Simmons said the public was on notice that items related to the budget were going to be discussed.
