(State Attorney General gives opinion)….The opinion was solicited by the Calexico Unified School District. They wanted to know what to do with a Board member elected to both the City Council and the School Board. Historical opinions on the issue were that the two seats were not compatible, and the elected official should leave one or the other. The most recent opinion by the State Attorney General is that the school board can sue to remove the elected official serving on both entities at the same time. The issue deals with Joong Kim who was elected to both the School District Board of Trustees and the Calexico City Council. Kim has said in the past he was determined to hold down both seats. This week the school district board voted to file legal action against Kim to force him to resign from the School Board. Kim’s comment to the weekly newspaper, the Calexico Chronicle, is that he will defend any legal action filed against him. He has not commented to any other media.
