( Baja California provision on gay marriage unconstitutional)….That is the ruling of the Mexican Supreme Court.
The ruling was released by the court this week. The Court said a provision in the Baja California State constitution limiting marriage to heterosexual couples was unconstitutional. In a press release, the Court said the provision implicitly creates a violation to the principals of equality, because it gives a different treatment to homosexual couples with respect to heterosexual couples. One source says, however, the ruling does not overturn the state ban on Gay Marriages. They say every gay couple turned down for a marriage license in Baja California will have to go through similar court appeals.
