County Chair responds to allegations PDF Print E-mail

(Board Chairman responds to former IID Director)….Bruce Kuhn Tuesday told the Board of Supervisors that County litigation was miss-directed.

 Kuhn alleged the State of California, and not the Imperial Irrigation District, was responsible for environmental impacts at the Salton Sea, under the Quantification Settlement Agreement. The County has filed litigation to stop the QSA until air quality issues are worked out. The Supervisors did not respond Tuesday. Chairman of the Board Wally Leimgruber sent a response Wednesday through e-mail. The response was a copy of a Sacramento Superior Court decision against a filing by Cuatro Del Mar. The filing alleged the QSA was unconstitutional, specifically calling for the State to pay environmental costs at the Salton Sea as a result of the agreement. In his decision to reject the filing, Judge Candee determined the QSA only calls for the State to cover Environmental Impacts above a certain threshold. The Judge said the QSA specifically states the Coachella Valley Water District, San Diego County Water Authority and the Imperial Irrigation District are responsible for impacts up to $133 million. The state would be responsible for the impacts above and beyond that threshold. That is the legal position taken by the County.
