Kuhn says County litigation miss-directed

(Former IID Director says County suing the wrong entity)…Bruce Kuhn went before the Board of Supervisors Tuesday. He told the Board the lawsuit recently filed by the County was miss-directed. He said the litigation does not name the Imperial Irrigation District, but is aimed at them as well as all participants in the Quantification Settlement Agreement. Kuhn was an IID Director and one of the signers of the QSA. He said the agreement states all participants are responsible for litigation filed against the QSA. Kuhn said the QSA also clearly states the State of California is responsible for the environmental impacts on the Salton Sea, resulting from the QSA. The County’s suit asks that the QSA be halted until air-quality issues can be worked out. Kuhn also presented the Board with a 2008 from the Legislative Analysts Office. The report was authored by Legislative Analyst Elizabeth G. Hill and it reiterates Kuhn’s claim that the State is responsible for the environmental impacts at the Salton Sea. Kuhn said the litigation filed by the County served no purpose, other than to bridge a gap between the County and the District, when the two entities should be working to serve the same constituents. The County had some time ago filed comments against the validation of the QSA because of the Air Quality issues. Kuhn says the latest filing is just adding on. The Supervisors did not comment on Kuhn’s statements and accusations.
