(Jury misconduct forces retrial)….Proceedings against Louis Lopez will start over Tuesday. Lopez is facing charges of drug trafficking. Friday it was determined two jurors had discussed the fact the defendant had not taken the stand during his trial. That issue is prohibited for jury discussion during deliberations. Superior Court Judge Joseph Zimmerman ordered the defendant to appear in court Tuesday to discuss setting a new trial date. Defense Attorney John Breeze motioned for a new trial claiming the misconduct not only violated the juror instructions but also compromised his Fifth Amendment rights.
