(The victim of the Border Patrol shooting last week was shot by an M-4 rifle)….It was incorrectly reported Friday that the man had been shot by a shot-gun. The wrong information was passed along to the news department. Sheriff’s LT. George Moreno said Monday morning the investigation into the shooting confirmed Boarder Patrol reports.

El Centro Sector spokesman David Kim had said the Agent involved in the shooting had fired one shot from his M-4 service rifle. Moreno says video of the shooting substantiates Kim’s statement. Twenty year old Ramiro Gamez Acosta of Mexicali was reportedly part of a group that had crossed into the United States illegally from Mexico about a mile West of Calexico. When discovered by Border Patrol Agents the group allegedly began pelting the Agents with softball sized rocks, and one person even threw a Molotov Cocktail, which did not explode. The shooting victim reportedly tried to get back across the border fence, and began to scuffle with one of the agents. Kim says Gamez Acosta apparently cocked his arm to throw a rock at the Agent, and the Agent fired one round from his service rifle. The shot struck the Mexicali man in the chest. He was taken to El Centro Regional Medical Center, but was pronounced dead a short time later. Kim said after the shooting a group of about four went at the Agent who fired the shot and another Agent fired a round from his service shot-gun to stop them. Nobody was struck by that shot. Moreno says the investigation by his department is just about finished. He said it will be turned over to the District Attorneys office for determination. The Lt. said he understands an internal investigation is also being conducted by the Customs and Border Protection Department, but as far as he knows, the Federal Bureau of Investigations is not looking into the incident. The F B I will not say if they are or not.
