(Calexico lawsuit against the Imperial Irrigation District may be going to trial)…The City of Calexico filed the suit against the IID’s 2005 decision to increase municipal water rates. Initially the suit was dismissed, but the City appealed. The Fourth Circuit Court of Appeals in December that the suit should be returned to the trial court. The IID requested a Petition for Review of the lawsuit. Last week the California Supreme Court reportedly denied the Petition. Calexico officials say with the recent denial, they expect the lawsuit against the rate increase will move forward. The City claims the rate increase was improper. The IID has said they had not increased municipal water rates in several years, and they were well within their boundaries in their 2005 decision. |
