(CBP officer arraigned on an indictment)....The indictment was unsealed Wednesday.

Customs and Border Protection Officer Marcos Valenzuela was arraigned on the indictment before US Magistrate Judge Ruth Bermudez Montenegro. He is scheduled to appear before US District Court Judge Janis Sammartino on May 21 at 1:30 pm for a motion hearing. According to the indictment,  29 year old Valenzuela encountered an individual, identified only as J.L., on August 16, 2019 while on duty at the Calexico West Port of Entry. During the course of the inspection, Valenzuela allegedly deprived the individual of the Constitutional right not to be subjected to unreasonable force. The indictment also alleges that Valenzuela's actions resulted in bodily injury to the person seeking admission into the United States. The press release announcing the indictment does not say exactly what allegedly happened during the encounter.
