(The IID is getting a second opinion)…..The second opinion will be on the recent QSA litigation. Noted water attorney Stuart Somach will be at Tuesday’s Imperial Irrigation District Directors informational meeting. The meeting convenes at 5:00 pm. Before the public portion of the meeting, Somach will meet with the Board of Directors in closed session. During his presentation in open session, Somach will address specific questions from the Board as well as the public. Somach is a noted water attorney. He is a partner in the Sacramento law firm of Somach, Simmons and Dunn. He has a wide-ranging background in the practice of water and environmental law. Somach is a former assistant U.S. Attorney and past chairman of the American Bar Association’s water resources law committee. He has argued successfully before the U.S. Supreme Court and California Supreme Court on significant water cases involving public agencies. Tuesday’s presentation will be an analysis of the Quantification Settlement Agreement coordinated cases and the final ruling issued by Sacramento Superior Court Judge Roland Candee. The ruling was to invalidate the QSA based on the Judges conclusion that the State could not agree to an unlimited funding of the mitigation costs to the Salton Sea due to environmental consequences resulting from water transfers allowed under the QSA.
