(Decision expected this week)…Arguments wrapped up last week in Superior Court of California.

The first phase in litigation filed against the Imperial Irrigation District. The first phase deals with the validation of the Quantification Settlement Agreement, signed in 2003. Judge Roland Candee is hearing all phases of the litigation. Kevin Kelley, with the IID, says a written decision on Phase 1 is expected some time this week. The next Phase, dealing with the environmental issues at the Salton Sea, begins Monday December 14. The County is part of the litigation. Imperial County attorneys have contested the validation of the agreement, and, most recently, have filed against the environmental aspect of the agreement. The County wants the QSA stopped until the environmental concerns are addressed. The QSA allows for the transfer of conserved water to San Diego, Coachella Valley and the Metropolitan Water District. It is the largest transfer agreement ever implemented in the United States.
